Privacy Notice for California Residents
This section supplements our Privacy Policy and applies solely to California residents. It is provided to comply with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, the "CCPA"). Terms defined in the CCPA have the same meaning when used in this section.
Categories of Personal Information We Collect
In the preceding 12 months, we have collected the following categories of personal information from California residents through the Site:
| Category | Examples | Collected From |
|---|---|---|
| Identifiers | Name, company name, email address, phone number, IP address | You directly (contact and inquiry forms, email); automatically via our website platform (Shopify) |
| Commercial information | Products you inquire about; catalog or quote requests | You directly |
| Internet or other similar network activity | Pages viewed, browser and device type, date and time of visit | Automatically via our website platform (Shopify) |
| Professional or employment-related information | Company name, job title, business contact details you provide | You directly |
We do not collect sensitive personal information as defined by the CCPA. We do not knowingly collect personal information from consumers under 16 years of age. We do not use automated decision-making technology to make significant decisions about consumers.
How We Use and Disclose Personal Information
We use personal information for the business purposes described in the "How We Use Information" section of our Privacy Policy above: responding to inquiries, providing requested materials, operating and improving the Site, security, and legal compliance.
We disclose personal information only to the service providers described in the "How We Share Information" section above (such as our website hosting and email providers), under contracts that restrict their use of the information to providing services to us; for legal and safety purposes; or in connection with a business transfer.
We do not sell personal information, and we do not share personal information for cross-context behavioral advertising. We have not done either in the preceding 12 months, and we have no actual knowledge of selling or sharing the personal information of consumers under 16 years of age. Because we do not sell or share personal information, we do not offer an opt-out mechanism or respond to opt-out preference signals such as the Global Privacy Control, as there is nothing to opt out of.
We do not use or disclose personal information for purposes incompatible with those described in this policy without first providing you notice.
Retention
We retain personal information as described in the "Data Retention" section above: for as long as needed to respond to your inquiry, maintain our business relationship with you, or as required by law. We do not retain personal information longer than reasonably necessary for these purposes.
Your Rights Under the CCPA
If you are a California resident, you have the right to:
- Know/Access — request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, our purposes for collecting it, and the categories of third parties to whom we disclose it. You may request information beyond the preceding 12 months (for information collected on or after January 1, 2022).
- Delete — request that we delete personal information we collected from you, subject to certain exceptions permitted by law.
- Correct — request that we correct inaccurate personal information we maintain about you.
- Non-Discrimination — not receive discriminatory treatment for exercising any of these rights. We will not deny you services, charge you different prices, or provide a different level of service because you exercised your CCPA rights.
How to Exercise Your Rights
To submit a request to know, delete, or correct, contact us by:
- Calling us at (530) 438-2126
- Emailing us at info@seedsbydesign.com
Only you, or someone legally authorized to act on your behalf, may make a request related to your personal information. When you submit a request, we will need to verify your identity by matching information you provide against information we maintain — for a Site like ours, this typically means confirming you control the email address or phone number associated with the information. We will only use information provided in a request to verify the requestor's identity or authority.
You do not need to create an account with us to submit a request. If you use an authorized agent, we may require the agent to provide proof of your written permission and may require you to verify your identity directly with us.
Our Response Timing
We will confirm receipt of your request within 10 business days and endeavor to respond substantively within 45 calendar days. If we need more time (up to an additional 45 days), we will notify you of the reason and extension in writing. We do not charge a fee to process requests unless they are excessive, repetitive, or manifestly unfounded, in which case we will explain why and provide a cost estimate before completing the request.
If we deny your request in whole or in part, we will explain the reasons in our response.
California "Shine the Light"
California Civil Code Section 1798.83 permits California residents to request information about our disclosure of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their direct marketing purposes.
